Terms of Service
These Terms of Service (the "Terms") govern your use of SecondBrain (the "Service"). By creating an account or using the Service, you accept these Terms. If you do not agree, please do not use the Service.
1. Who we are
The Service is provided by Alessio Gedda, a natural person established in Italy (the "Provider"). You can reach us at alessiogedda@yahoo.com.
2. The Service
SecondBrain is a personal knowledge and life-management tool that lets you store notes, tasks, plans, contacts, financial and health tracking, bookmarks and related content. The Service is currently provided free of charge. Voluntary tips do not purchase any feature or guarantee.
3. Eligibility
You must be at least 14 years old to use the Service. By using it you confirm that you meet this requirement.
4. Your account
You are responsible for keeping your credentials secure and for all activity under your account. Provide accurate registration information and notify us of any unauthorised use. We may suspend or terminate accounts that breach these Terms or applicable law.
5. Acceptable use
You agree not to use the Service to break the law, infringe others' rights, upload unlawful content, attempt to gain unauthorised access, disrupt the Service, or use it to store data on behalf of third parties without a lawful basis.
6. Your content and third-party services
You retain all rights to the content you create. You are solely responsible for it and for having the right to store it. The Service can reference information from YouTube, Twitch and RSS sources; your use of those third-party services is governed by their own terms, not ours.
7. Availability and "as is"
The Service is provided "as is" and "as available", without warranties of any kind. We do not guarantee that it will be uninterrupted, error-free or that data will never be lost. You are encouraged to keep your own backups of important content.
8. Limitation of liability
To the maximum extent permitted by law, the Provider is not liable for indirect or consequential damages, or for loss of data or profits arising from your use of the Service. Nothing in these Terms limits liability that cannot be excluded under mandatory Italian or EU consumer law.
9. Termination
You can stop using the Service and delete your account at any time from your Profile page; deletion permanently removes your data. We may suspend or discontinue the Service, or terminate accounts that violate these Terms, giving notice where reasonably possible.
10. Data protection
We process personal data as described in our Privacy Policy and Cookie Policy, which form an integral part of your relationship with the Service.
11. Governing law and jurisdiction
These Terms are governed by Italian law. Mandatory consumer-protection rules of your country of residence remain unaffected. For disputes, the courts of the consumer's place of residence have jurisdiction where required by law.
12. Changes to these Terms
We may update these Terms; the date above reflects the latest version, and significant changes will be communicated within the Service. Continued use after changes means you accept the updated Terms.
